Description: Representing even competent clients can be difficult enough sometimes. Add an overlay of diminished capacity – whether by age, mental impairment, or some other reason – and representation can become very tricky to navigate. Lawyers’ ethical rules presume that clients are competent or at least able to direct their representation. When they can’t, what do you do?
